These Terms of Service ("Terms") govern your use of Scout, a mobile application for discovering and sharing photography and videography spots (the "App"), operated by Kenneth Sieu ("we", "us"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
You are responsible for the activity on your account and for keeping your sign-in credentials secure. You agree to provide accurate information and to update it as needed. We may suspend or terminate an account that violates these Terms or that we reasonably believe has been compromised.
The App lets you submit photos, ratings, notes, spot coordinates, and other information ("Your Content"). You retain ownership of Your Content. You represent and warrant that:
By submitting Your Content, you grant Kenneth Sieu a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for example, to resize images, strip EXIF metadata, or generate previews), publicly display, and distribute Your Content within the App and in materials promoting the App. This license continues for content that remains in the App after your account is deleted, consistent with our Privacy Policy's anonymization practices.

We may, but are not obligated to, review, remove, or restrict any content for any reason, including suspected violation of these Terms. We may also remove spots whose locations appear unsafe, unlawful to access, or otherwise inappropriate to share.
You are solely responsible for your safety and conduct at any location you visit using the App. Spots are user-submitted and may be on private property, in restricted or hazardous areas (including cliffs, water, weather-exposed terrain, and remote backcountry), or subject to permits, fees, seasonal closures, or local laws. Conditions change. We do not verify access rights, accuracy, or safety of any spot.
Before visiting a spot, confirm that you have permission to be there, that your planned activity (including drone use) is lawful, and that you can do so safely given your skill, equipment, and the current conditions. Follow Leave No Trace practices and respect the location.
The App, including its design, code, branding, and original content we provide, is owned by Kenneth Sieu and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for its intended purpose. All rights not expressly granted are reserved.
To report content that violates these Terms, including copyright infringement or privacy concerns, contact us at kkennethsieu@gmail.com with enough detail for us to locate the content and evaluate the report.
You can stop using the App and delete your account at any time. We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including license, disclaimers, limitation of liability, and governing law) will survive.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THE ACCURACY, RELIABILITY, OR AVAILABILITY OF SPOT INFORMATION. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, KENNETH SIEU AND HIS AFFILIATES, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP OR ANY LOCATION YOU VISIT BECAUSE OF IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY TO THE FULLEST EXTENT PERMITTED.
You agree to defend, indemnify, and hold harmless Kenneth Sieu from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the App, your visits to any location, or your violation of these Terms or any law.
We may modify the App or these Terms from time to time. If we make material changes to the Terms, we will update the "Last updated" date and provide additional notice where appropriate. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Kenneth Sieu agree to resolve any dispute in the state or federal courts located in California, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer law.
If you obtained the App through the Apple App Store, you acknowledge that these Terms are between you and Kenneth Sieu, not Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You agree to comply with the Apple Media Services Terms in addition to these Terms.
These Terms are the entire agreement between you and Kenneth Sieu regarding the App. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a sale of the App or its assets.
